Fences in North Muskegon

A zoning permit for anything over 30 inches, a 30-foot setback from the high-water mark on waterfront lots, and a 2-foot limit on solid front-yard fences.

North Muskegon is a small city on the north side of Muskegon Lake, across the water from the City of Muskegon. It had 4,093 residents at the 2020 census. More than half of its 4.12 square miles is water, and the Muskegon River flows into Muskegon Lake in the east part of the city. Many lots front the water, so the waterfront rule matters here more than in most places. The fence rules are in Section 10.02 of the city's zoning ordinance.

Permit and fees

Section 10.02 requires a zoning permit for any fence or wall higher than 30 inches. The city's building permit fee schedule, effective January 1, 2024, lists $95 for a fence building permit, plus a zoning compliance permit. Budget for both on top of the installer's price.

Placement

  • Fences have to be outside the public right-of-way and set back at least 1 foot from the right-of-way line. Otherwise they can be on the property line.
  • If utilities prevent placing a fence at the property line, it goes on the utility easement line nearest the property line.
  • Fences have to follow the city's clear vision area rules at corners.
  • Waterfront lots: rear-yard fences can be no closer than 30 feet from the high-water mark, as determined by the zoning administrator.

Height

Height is measured from the lowest ground level within 3 feet of either side of the fence, to the top. Posts can stick up a maximum of 6 inches above the fence. On a sloped lot, that measurement rule can make the fence shorter than you planned.

WhereLimit
Required front yard, open fence (decorative metal, chain link)4 ft
Required front yard, solid fence or wall2 ft
Required side and rear yards, residential6 ft

Note the front-yard chain link issue. The table above treats chain link as an open fence, but the same section also says chain link fence material isn't permitted in a front yard unless the section otherwise permits it. Ask the city how it applies the two before choosing chain link for a front yard. Decorative metal avoids the question. See aluminum fences.

Materials and finish

Fences have to be made of ornamental metal, rot-resistant wood, or other high-quality, durable materials. The finished side has to face outward, toward neighboring lots and the street. Barbed wire, concertina wire, and electric fences are only allowed in the ID Industrial District. Fences must be maintained, including repairing or replacing damaged parts with matching materials and removing graffiti.

Building near the water

The 30-foot high-water setback means a waterfront rear yard fence usually stops well short of the shoreline. Lakeside ground is often loose sand or wet. USDA describes the Rubicon series as forming on dunes and beach ridges, and wetter Granby soils have a high water table. Posts in these conditions are usually set deeper or in concrete. Ask the installer how they'll handle it. If your lot borders the lake, HomeGuide's caution that vinyl privacy fences can sway in high wind is worth keeping in mind too.

Cost

HomeGuide's national averages put most fences at $20 to $60 per linear foot installed, with aluminum at $25 to $75 and vinyl at $30 to $60. See the fence cost guide. Michigan's MISS DIG law requires notice at least 72 hours before digging post holes.

What to include in your request

  • Whether the lot is waterfront.
  • Which yards you want fenced, approximate length, and height.
  • Material, and whether any part is in the front yard.
